Please read these terms carefully before using our website or making a donation to The Chahal Foundation.

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website operated by The Chahal Foundation ("we," "us," or "our"), a California nonprofit public benefit corporation and 501(c)(3) tax-exempt organization (EIN: 39-5160137).

By accessing or using our website at chahalfoundation.org, making a donation, or participating in any of our programs, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Donation Terms

General Donation Terms

  • The Foundation is a 501(c)(3) public charity. A qualifying contribution may be deductible to the extent allowed by law and the donor should obtain tax advice for individual circumstances.
  • A gift is accepted only after the relevant payment or asset transfer is verified and the Foundation confirms it can accept the gift.
  • General gifts may support approved charitable programs and operations subject to governing documents, gift-acceptance policies, and applicable law.
  • A designation applies only when it is accepted and recorded by the Foundation; contact the Foundation before initiating a restricted or unusual gift.
  • A payment-processor confirmation documents transaction status. A separate Foundation receipt or acknowledgment is issued only when the underlying gift record has been verified.
  • Donors are responsible for retaining or requesting the written acknowledgment and other substantiation required for their own tax reporting.

Donation Acknowledgment

A receipt or acknowledgment should state whether goods or services were provided and, when applicable, include a good-faith estimate of their value. Do not assume that an event ticket, auction purchase, membership benefit, or other exchange is fully deductible. The donor is responsible for determining and substantiating any deduction.

Refund Policy

Generally Non-Refundable

Donations to The Chahal Foundation are generally non-refundable. Once a donation is completed, it is considered a charitable gift and becomes the property of the organization.

Contact the Foundation promptly if a transaction appears duplicated, unauthorized, or incorrect. Do not submit a replacement payment until the original transaction status has been checked.

Exceptions

A refund or correction request may be reviewed in circumstances such as:

  • Duplicate charges or processing errors
  • Unauthorized use of payment method
  • Technical errors resulting in incorrect amounts
  • Fraud or identity theft

To request a review: Use the contact form as soon as possible and include the transaction details. Eligibility, processor timing, return method, accounting treatment, and any receipt correction depend on the facts and applicable requirements; no fixed approval or processing window is promised here.

Recurring Donation Terms

When a recurring-gift option is shown as available and you complete the payment provider's authorization, the selected amount may be charged at the displayed interval until the authorization is changed or canceled through a confirmed path.

Your Rights

  • Review the amount and interval before authorizing
  • Request a cancellation or change through the Foundation
  • Keep processor confirmations and issued receipts
  • Report an unexpected charge promptly
  • Confirm the effective date of any requested change

Important Information

  • Processor cutoffs can affect whether the next scheduled charge can be stopped
  • A cancellation request does not reverse prior completed gifts
  • A change is not complete until the provider or Foundation confirms it
  • No annual reminder or self-service donor portal is promised unless it is shown as active

How to manage recurring donations: Use the contact form and provide enough information for the Foundation to locate the gift. The team will confirm when a requested change or cancellation takes effect.

Payment Processing

When online card giving is enabled, the checkout uses the configured payment processor:

Stripe

For credit card, debit card, Apple Pay, and Google Pay transactions.

  • Payment availability depends on the current Foundation configuration
  • Full card details are submitted to the payment processor
  • Processor terms and privacy practices also apply

The Foundation website is not designed to store complete card numbers. Review the privacy policy and the payment provider's disclosures before submitting payment information.

Peer-to-Peer Fundraising

When the Foundation authorizes or links a peer-to-peer fundraiser, the fundraiser must identify the recipient, platform, purpose, and current terms. By creating or promoting such a fundraiser, you agree to the following:

Fundraiser Requirements

  • All funds raised go directly to The Chahal Foundation
  • Fundraiser content must be accurate and not misleading
  • No offensive, discriminatory, or inappropriate content
  • No promotion of other organizations or personal causes
  • Must be 18 years or older to create a fundraiser (or have parental consent)

Prohibited Activities

  • Misrepresenting affiliation with The Chahal Foundation
  • Using Foundation branding without authorization
  • Making false claims about tax deductibility
  • Soliciting funds for personal benefit
  • Engaging in harassment or spam

Note: We reserve the right to review, modify, or remove any fundraiser page that violates these terms or does not align with our mission and values. Tax treatment and receipts depend on the legal recipient, payment flow, goods or services, and the records generated by the platform and Foundation.

User Responsibilities

When using our website and services, you agree to:

  • Provide accurate and truthful information
  • Not use the website for any unlawful purpose
  • Not attempt to gain unauthorized access to our systems
  • Not interfere with the proper working of the website
  • Not transmit viruses, malware, or other harmful code
  • Not impersonate any person or entity
  • Not collect or harvest information about other users
  • Comply with all applicable laws and regulations

Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of The Chahal Foundation or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our website without prior written permission, except for personal, non-commercial use.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE CHAHAL FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • (i) Your access to or use of or inability to access or use the website;
  • (ii) Any conduct or content of any third party on the website;
  • (iii) Any content obtained from the website; or
  • (iv) Unauthorized access, use, or alteration of your transmissions or content.

THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Indemnification

You agree to defend, indemnify, and hold harmless The Chahal Foundation and its directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the website.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the website shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

Before initiating any legal action, you agree to first attempt to resolve any dispute informally through our contact form.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you a notification).

Your continued use of the website after any changes to these Terms constitutes acceptance of those changes. We encourage you to review the Terms periodically.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the original provision.
